Custom Manufacturing Terms & Conditions
What can CYOS manufacture?
We can manufacture food supplement sachets, tubs, capsules, pouches, beverages, droppers, tinctures and nasal sprays. We cannot manufacture medicines or products to be registered with the TGA.
The estimated minimum cost quoted of $2,000 on the website is based on having a product manufactured in the CYOS Canning Vale food manufacturing facility. We may need to have your product manufactured in a different facility if we (CYOS) deem it not able to be manufactured in our Canning Vale facility. This could be for various reasons such as (but not limited to) CYOS not having the capacity, machinery or license to manufacture a particular product. For example the CYOS Canning Vale facility is only licensed to manufacture food products. If you require a beverage manufactured then we may need to use a third party affiliates manufacturing facility to produce the beverage and costs can be higher. Once you have discussed your product with us and had a production plan prepared we will be able to give you an indication of cost.

Any product manufactured in the CYOS Canning Vale WA facility cannot be listed with the TGA.
Third Party Affiliate Facilities
CYOS may utilise other third party affiliate facilities to have you product manufactured. We may need to have your product manufactured in a different facility if we (CYOS) deem it not able to be manufactured in our Canning Vale WA facility. This could be for various reasons such as (but not limited to) CYOS not having the capacity, machinery or license to manufacture a particular product. Once you have purchased a production plan and one of our lab scientists has been in contact with you, we will complete an assessment of your product and we will discuss your manufacturing options with you. This will include an assessment of whether your product can be manufactured in the CYOS Canning Vale WA food facility or a third party affiliate facility.
Ingredients and Packaging
CYOS has access to a very extensive range of ingredients, flavours, sweeteners, colouring, additives and packaging to be used in your product creation. There is not much limit on the types of ingredients, flavours, sweeteners, colours, additives and packaging that can be included as long they are legal in Australia. The type of ingredients and packaging available to you for your product will depend on whether you are having your product manufactured in our food facility or in a TGA facility as a medicine. If you are having it manufactured in our food facility then you have two choices. You can have it manufactured as a food product and you will need to comply with the Food Standards of Australian (https://www.foodstandards.gov.au/). Or if you are having it manufactured in our food facility as a research product only then there will be very little limit on the types of ingredients, flavours, sweeteners, additives, colouring and packaging you can use (as long as they are legal). If you are having it manufactured as a medicine in a TGA facility then you will need to comply with the TGA regulations and this will place limits on the ingredients, flavours, sweeteners, additives and packaging used. (https://www.tga.gov.au/).
During the production plan process you will be able to speak to one of our Lab Scientists. They will be able to provide you with important information regarding your product creation. The Production Plan may include the following information provided to you via an electronic PDF booklet. CYOS reserves the right to omit certain information it deems necessary. To give you an example of where we may have to omit information: If your product is not manufactured in our food facility and it has to be manufactured in one of our affiliate TGA facilities then we may not have access to all the information (as this information is controlled by our affiliate). We therefore may not be able to provide you with all the information. However where possible we will endeavor to provide you with all the information.
For each product creation we will search our extensive supplier database to find you the best value ingredients. We always prioritise quality and best price for the ingredients in our clients products. This includes if necessary, flavours, colouring and other additives such as sweeteners.
We are fully transparent in all our activities and this includes suppliers. We will provide you with ingredient supplier information where possible.
Our Lab Scientists will be able to provide you with general information on the food/medicine regulatory environment in Australia. Please note that we cannot provide you with regulatory advice for your product. We can provide you with factual information only. If you require specific regulatory advice we can refer you to a consultant.

Quality Control procedure
Where possible this information will be provided to you. CYOS follows a strict quality control procedure. All ingredients used in your product creation are validated and checked via our QC program.
We will liaise with you to determine how you would like your product shipped. We will always endeavour to provide you with the best price on your shipping and shipping times can be catered to your needs. We can offer overnight, express post, international or shipping by sea and more.
CYOS has access to all types of packaging options however what types of packaging options available for your product will also depend on what type of products you are having manufactured i.e. Food product, research product or TGA compliant medicine. There are regulations imposed by the TGA on what types of packaging can be used for medicines. We will be able to discuss your options with you when completing your production plan.
Final cost to client
Once the production plan is completed we will be able to give you a final cost and invoice to have your product manufactured. Please note that due to the volatility in the ingredient prices and currency fluctuations all quotes and invoices are only valid for seven (7) days. After this time we will need to recalculate the cost however there is no charge for this.
When having a custom sample manufactured by us (CYOS) for you, we will generally produce one (1) unit of your custom product for you to sample. For example if you would like 100kg of a custom flavoured protein powder packaged into 1kg Tubs (100 x 1kg Units), then we will generally provide you with a 1kg custom sample of your product. However please note, CYOS reserves the right to reduce the custom sample size at our discretion. We would normally only do this if the ingredients used in your product are extremely expensive and your per unit product is large. Custom samples are not for resale and are for research purposes only. Customs samples will be provided to you in packaging chosen by CYOS at our discretion. For example custom powder samples are generally provided in pouches, custom capsule samples are provided in capsule bottles and so forth.
If you are having a custom sample being made that is flavoured and/or coloured then we will allow two (2) amendments in total to the original flavour or colouring. Please note that the amendments can only be made to the original flavour or colour, you can not change the specific flavour or colour requested for that specific sample. To do this you will need to have a new sample produced at your expense. For example if you are having a blue raspberry custom sample made (blue colouring and raspberry flavouring) then we can amend the blue colouring to make it lighter or darker and the raspberry flavour to make it stronger, sweeter or more/less acidic. Only two (2) amendments can be made in total. This means we will only send you out an additional two (2) samples (of the specific original sample) once you have received the original sample. You can have multiple changes within the two additional samples, for example you can change brightness of colour, sweetness and acidity all within the same amended sample.
Labels for your Custom Product
If you have a label already organised then you have two options. (1) You can send the design to us and we can organise to have it printed and then put on the packaging for you. Or (2) you can have us send your product to you unlabeled and you print the label and stick it on the packaging yourself. If you don’t have a label design organised, do not worry. We can organise one for you as per our Custom Label service.
You will be required to provide CYOS with a complete legible drawing/sketch of how you would like your label to look like. You will then get a maximum of five (5) amendments to the original draft custom label presented to you. You will also be required to provide us with all the information (text) for your label such as (but not limited to) serving size, warnings, nutritional information, servings per package.
Time Frames for Custom Manufacturing, Custom Sample and Production Plans.
If you are having a custom product or custom sample manufactured in our (CYOS) Canning Vale food facility then the usual time to have a product or sample manufactured is 4 to 8 weeks. If you are having a product manufactured in one of our third party affiliate facilities then the time frame is 3 months or longer, unfortunately we cannot give an estimation of time for a third party affiliate manufacturing as this is out of our control.
Production Plans will generally be completed for you within 5 – 10 business days.
Please note we (CYOS) reserves the right to increase or decrease all time frames if we deem it necessary. For example this can happen if there is a global shortage of a particular ingredient and it is not available or if there is a delay in shipping of ingredients to us .However we will always endeavor to work with you to complete your manufacturing as soon as is reasonably possible.
CYOS can provide you with the general regulatory information and where to access regulatory information however CYOS cannot provide regulatory advice as it relates to your product. If you require specific regulatory advice we can refer you to a consultant.
CYOS does not provide advice on ingredient selection or amounts as part of your production plan or sample. We will provide advice on where to source your chosen ingredients. If you require advice on ingredient selection and amounts please let us know and we can discuss this with you.
CYOS does not provide advice on content for your label as part of your production plan or sample. We provide a graphic design service and logo service only. We can provide you with examples of other labels currently in the marketplace that may be similar to your product however we are not responsible for the final label content and regulatory compliance. If you require label advice please contact us and we can discuss this further with you.
